The terms “we,” “us,” and “our” refer to Retro Reup. Retro Reup operates this website and online store, including all related content, features, tools, products, and services (the “Services”).

Our store is powered by Shopify, which enables us to provide the Services to you.

By accessing, browsing, or purchasing from our Services, you agree to be bound by these Terms of Service, our Shipping Policy, our Returns & Refund Policy, and our Privacy Policy.

If you do not agree to these Terms, you may not access or use the Services.

SECTION 1 – ELIGIBILITY & ACCOUNT RESPONSIBILITY

You represent that you are at least the age of majority in your state of residence.

You agree to provide accurate, current, and complete purchase and account information.

You are responsible for maintaining the security of your account and for all activity under your account.

Accounts may not be transferred, sold, or assigned.

We reserve the right to suspend or terminate accounts suspected of fraud, abuse, or policy violations.

SECTION 2 – PRODUCT REPRESENTATION & CONDITION

We make every effort to display products accurately. However:

  • Colors may vary due to screen differences

  • Lighting and background editing may affect appearance

  • Backgrounds may be digitally altered for presentation purposes only

  • Condition descriptions are based on visual inspection and functional testing

All photos are considered part of the item description.

Unless otherwise explicitly stated, what is shown in the listing photos is exactly what is included in the sale.

Many items sold are pre-owned, resale, collectible, vintage, or discontinued goods. Normal signs of age, storage, shelf wear, display wear, fading, minor scratches, blemishes, or handling may be present unless specifically stated otherwise.

Minor manufacturer variances, including but not limited to glue residue, stitching inconsistencies, cosmetic factory imperfections, or paint irregularities, are considered normal production characteristics and are not defects.

For sealed items, breaking factory seals, shrink wrap, or protective packaging voids return eligibility unless the item is defective.

Certain items may include security verification measures. Removal, alteration, tampering, or damage to any security feature voids return eligibility.

All items are sold as described in their individual listings.

SECTION 3 – CATEGORY-SPECIFIC DISCLOSURES

Shoes

The product’s box is in overall acceptable condition unless otherwise pictured or stated. Store labels or retail stickers may be present.

Shoes shown in photos may contain paper stuffing or shoe trees for display purposes; shoe trees are not included unless explicitly stated.

Due to age and material composition, some older brand-new (deadstock) shoes may experience natural crystallization, sole separation, glue separation, midsole breakdown, or material degradation upon wear. We are not responsible for age-related conditions that occur after wear.

Sizing is based on tag or best-fit estimation. Fit may vary by brand, model, and era.

Clothing & Apparel

Customers are responsible for reviewing measurements (if provided) or consulting manufacturer sizing charts prior to purchasing.

Video Games & Media

Product box, case, and manual condition may vary. Labels or stickers may be present inside, on the case, or on the inner disc ring.

Manuals are included only if shown in the listing photos.

Physical disc condition may vary. All discs are tested for functionality. Condition is based solely on working performance, not cosmetic appearance.

SECTION 4 – RESALE STATUS & BRAND DISCLAIMER

Retro Reup operates as an independent resale retailer.

Products are lawfully acquired and resold under the First Sale Doctrine.

We are not affiliated with, endorsed by, sponsored by, or authorized by any brand or manufacturer unless explicitly stated.

All trademarks, logos, and brand names are the property of their respective owners and are used for identification purposes only.

SECTION 5 – ORDERS

When you place an order, you are submitting an offer to purchase.

We reserve the right to:

  • Accept or decline orders

  • Limit quantities

  • Cancel orders due to pricing errors

  • Cancel orders due to suspected fraud

  • Cancel orders due to inventory synchronization errors

  • Cancel orders pending verification

An order is not considered accepted until payment has been processed and confirmed.

If an order is canceled, you will be notified and refunded.

All purchases are subject to our Shipping Policy and Returns & Refund Policy.

SECTION 6 – PRICING

Prices are subject to change without notice.

Posted prices do not include taxes or shipping unless explicitly stated.

In the event of a pricing, listing, or synchronization error, we reserve the right to cancel the order and issue a refund prior to shipment.

SECTION 7 – SHIPPING & DELIVERY

Shipping terms are governed by our Shipping Policy.

Orders are typically processed within 1–3 business days.

Delivery timelines are estimates only and are not guaranteed.

Risk of loss transfers to the customer upon confirmed delivery by the shipping carrier to the address provided at checkout, subject to applicable Massachusetts consumer protection law.

We are not responsible for delays caused by carriers, weather, customs, or events outside our control.

SECTION 8 – RETURNS & REFUNDS

Return eligibility is governed exclusively by our Returns & Refund Policy.

Items must be returned in the exact same condition received.

Items returned without required security features intact, or showing signs of wear, use, damage, part swapping, or alteration, may not qualify for a full refund.

Nothing in these Terms limits rights granted under applicable Massachusetts consumer protection laws.

SECTION 9 – INTELLECTUAL PROPERTY

All website content, including text, images, graphics, logos, and design, is the property of Retro Reup or its licensors.

You may not reproduce, distribute, modify, or exploit any content without prior written consent.

We may provide access to third-party tools or links.

We are not responsible for third-party content, policies, or practices.

Use of third-party tools is at your own risk.

SECTION 11 – DISCLAIMER OF WARRANTIES

EXCEPT AS EXPRESSLY STATED, ALL PRODUCTS AND SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE.”

To the fullest extent permitted by law, we disclaim all implied warranties, including but not limited to merchantability and fitness for a particular purpose.

Some jurisdictions do not allow certain warranty disclaimers, so portions may not apply to you.

SECTION 12 – LIMITATION OF LIABILITY

To the fullest extent permitted by law, Retro Reup shall not be liable for indirect, incidental, special, or consequential damages arising from use of the Services or purchased products.

Our total liability shall not exceed the amount paid for the product in question.

Nothing in this section limits rights provided under applicable Massachusetts consumer protection laws.

SECTION 13 – FRAUD & CHARGEBACKS

We actively monitor transactions for fraud.

Orders suspected of fraud may be canceled or delayed pending verification.

If a chargeback is initiated after confirmed delivery without prior contact for resolution, we reserve the right to provide supporting documentation to the payment processor, including tracking confirmation and signature confirmation records when applicable.

Fraudulent chargebacks may result in permanent account suspension.

SECTION 14 – TERMINATION

We reserve the right to suspend or terminate access to the Services at our discretion for violations of these Terms.

SECTION 15 – GOVERNING LAW

These Terms are governed by the laws of the Commonwealth of Massachusetts.

Any disputes shall be resolved in the courts located within Massachusetts.

We may update these Terms at any time by posting revisions on this page.

Continued use of the Services constitutes acceptance of any changes.
